XX Meeting of COM/CITEL will be held in San Jose, Costa Rica from December 3 to 5, 2008

III Meeting of the PCC.I Ad Hoc Working Group on Legal Matters
on April 25-26, 1995,
Washington, D.C.

The Permanent Consultative Committee I (PCC.I) Ad Hoc Working Group on Legal Matters held its third meeting at the OAS Headquarters on April 25-26, 1995. On its agenda were three significant items;

  1. coordination with the International Branch of the ABA and the Inter-American Bar Association on the Administrative Procedures Project,
  2. the future terms of reference of the Working Group and its response to the Summit of the Americas and
  3. establishing a schedule with the ITU to complete the revision of the Blue Book.

A total of 64 experts from thirteen Member Countries and three international organizations participated in the meeting of the Working Group. CITEL, the ABA and the IABA have been working together for approximately the past two years to define the differences between the legal systems of Member Countries of the OAS, by examining and comparing their Administrative Procedures. An agreement has been reached on a questionnaire to be employed in the collection of information, how the information is to be collected, the type of report that will be prepared and a tentative schedule adopted for completion of the initial phase of the work.

The meeting also considered a request from PCC.III to comment on a recommendation adopted at their meeting in Venezuela requesting Members to consider the possibility of establishing a Legal Working Group in PCC.III. This topic generated a lot of discussion. Participating in the meeting was the Chairman of COM/CITEL and he expressed the opinion that CITEL should have only one Working Group on Legal matters. It was his recommendation that the Working Group should concentrate on a proposal to COM/CITEL that would result in a joint Working Group of all the PCCs that would address legal matters of concern to CITEL. Such a Working Group would be open to participation by Associate Members regardless in which PCC they have become a Member.

The Working Group then proceeded to develop terms of reference for itself which clarifies its responsibilities. Prior to this time, the Working Group was operating under a very general mandate which raised some apprehension among Members. The Working Group will present its new terms of reference to PCC.I in September for their approval along with the recommendation that the Working Group become a joint Working Group of all three PCCs.

A representative of the ITU was present to propose to the Working Group how to proceed with the updating of the Blue Book. The ITU has hired a consultant to work with CITEL Members to add new material to the Blue Book for the purpose of increasing its value to Member Countries. The ITU would also like to use the Blue Book as a model for similar efforts in the other regions of the world. A target date of December has now been agreed upon to complete this update of the Blue Book.

The next meeting of the Legal Working Group has been set for October in Argentina. The Executive Secretary and the host government are working out the exact dates for the meeting. The Working Group Chairperson, Iris Marie Struiken-Wijdenb has indicated that the Spring 1996 meeting of the Working Group will be in Suriname.
