Regulation in the Telecommunications Sector

For countries to develop the telecommunications they need, they are obliged to solve an array of problems, whether of a technical, economic, or legal nature. Regulation may therefore be defined as the set of formal solutions (policies and technical regulations) adopted in each country to carry out any telecommunications activity. The telecommunications development policies adopted will depend on the economic model chosen by a country.

Since the regulations adopted in a country correspond to solutions addressing the interests of diverse sectors and their needs, it may be said that all regulatory matters must be examined in terms of different sectors, such as the state, the regulator, the operator, and the users.

Given the importance of this topic, the International Telecommunication Union (ITU) and the Center of Excellence for the Americas Region, through the Excellence Network Node and the CITEL Regional Training Center: the National Institute for Telecommunication Research and Training of Peru (INICTEL), are offering the international course: “Regulation in the Telecommunications Sector,” which is geared to planners, directors, managers, and decision-makers in the regulatory area. Its purpose is to give a broad overview of the principal technical, economic, legal, and development-policy aspects of telecommunications activities. Participants will be able to examine the conceptual bases of regulation and of the evolution of rules in order to introduce appropriate and effective regulatory changes in their countries.

It is abundantly clear from numerous recommendations and documents of international organizations that telecommunication activities require the ongoing application of clear, specific regulations. The intention here, therefore, is not to describe the regulatory framework of specific regulations but rather to methodically examine the following: Which components are included in telecommunications regulation? Which areas call for the adoption and application of regulations?

Among the topics to be covered in this course, scheduled for October 2005, are: the technical and conceptual explanation of public telecommunications networks and services, the organization of telecommunications activities, the establishment of plans for developing services and the feasibility of their implementation, fulfillment of the goals and objectives of the development of telecommunications networks and services, strategic plans of operators and of the state for the development and enforcement of regulations, the influence of technological change on the development of regulations, and global and regional regulatory trends.
