Provision of satellite capacity in Peru

In August 2005, the Ministry of Transport and Communications adopted the standard regulating the provision of satellite capacity through geostationary satellites to the holders of telecommunication service concessions and authorizations operating in Peru.

This standard recognizes any natural person or legal entity, whether national or foreign, who is registered in Peru to provide satellite capacity.

To register, the petitioner is required to provide relevant legal information, the description of the satellite system to be operated, including the documents issued by the competent entities regarding the satellite station where the results of the coordination, notification and registration procedures of the frequency assignments made with the ITU appear, as well as the identification of the satellites that provide satellite capacity to the holders of telecommunication service concessions and authorizations, including the following information for each case:

  • Orbital position

  • Frequencies and polarizations used

  • Satellite coverage beams

  • Equivalent radiated isotropic power

  • Date of start-up of satellite service

  • Useful life of the satellite

  • Number of transponders by frequency band and capacity

The satellite provider is obliged to provide capacity only to holders of telecommunication service concessions and/or authorizations that operate in the country and forward to the Ministry the agreements entered into with the holders of concessions and/or authorizations within a time-limit of no more than 10 days as of the signing of the agreements. Failure to fulfill these obligations renders the registration null and void.

As a rule, the satellite provider is obliged to meet the Ministry’s information requirements.

As for the telecommunication service concession and authorization holders [see notes below] they can only establish a satellite link through duly registered satellite capacity providers.

ELLIPSE Management System

It is a system that makes it possible to manage the administrative and technical information of telecommunication services: Documentary Procedures, Technical Management of Telecommunication Authorizations and Concessions, Channeling Plans, Equipment and Antenna Clearance and Homologation, automatic printing of Technical Annexes, Operation Permits, Homologation Certificates, among others, as well as the mission of administrative, technical, administrative/technical, managerial, and statistical reports for assistance in decision making.

At present the system contains the following: technical and administrative information of Broadcasting Services and Private Services, and the administrative information of public services. Software is being implemented so that the system can manage the technical information of these services.

The ELLIPSE Management System is part of the Integrated Radio Spectrum Control and Management System of the Deputy Ministry of Communications, along with the Technical Monitoring System

The system has a spectrum management tool, with which engineering calculations facilitating frequency assignment can be made (simulations: propagation models).

Among the main data of the Tx/Rx stations stored by the ELLIPSE system, the following are noteworthy:

  • Code

  • Type of service

  • Class

  • Operating power

  • Frequency (transmission and/or reception, as appropriate)

  • Time zones

  • Transmission

  • Location (address, geographical location, coordinates)

Notes:

Concession:  A legal act whereby the state grants to natural or juridical persons the power to provide a bearer, final, or broadcasting service of a public nature.  The concession is obtained by means of a written concession contract adopted by a decision of the Sector Authority (Article 47º of the Codified Single Text [Texto Único Ordenado] of the Telecommunications Law).

Permit: The power granted by the state to natural or juridical persons to establish a telecommunications service that does not require a concession to install and operate radiocommunication equipment (private radiocommunication and broadcasting services).
